Organization Terms
Effective date: October 26, 2026
These Organization Terms, including the Data Processing Terms in Part B, apply to any church, ministry, or other organization ("Organization," "you") that uses Be Small to manage its groups. They supplement our Terms of Service, which also apply to you. Be Small means Chris Unseth, an individual doing business as Be Small. If these Organization Terms conflict with the Terms of Service, these Organization Terms control for Organizations.
By setting up or administering an Organization on Be Small, you agree to these terms on behalf of the Organization and represent that you are authorized to do so.
Part A: Use of the Services
A1. Your Responsibilities
You are solely responsible for:
your groups, leaders, administrators, members, meetings, and activities, including the selection, screening, training, and supervision of leaders and any background checks your policies or the law require;
all information and content you or your people put into the Services ("Organization Data"), and having every notice, consent, and legal basis needed to collect it and to let Be Small process it, including consent to process information that may reveal religious beliefs;
making sure members are at least 18 years old;
complying with all laws that apply to you, including privacy, anti-spam, and telephone consumer protection laws (such as CAN-SPAM and the TCPA);
the actions of your administrators and leaders, and promptly removing access for anyone who should no longer have it; and
keeping your own copies of any Organization Data you need.
A2. Fees
Fees, if any, are as agreed in writing or as stated when you subscribe. Unless stated otherwise, fees are non-refundable and exclusive of taxes. We may suspend the Services for non-payment.
A3. Suspension and Termination
We may suspend or terminate an Organization's access at any time if we believe it is violating these terms, creating risk for Be Small or others, or required by law, or for convenience with 30 days' notice. You may stop using the Services at any time. Within 30 days after termination you may request an export of your Organization Data, after which we will delete it as described in Part B.
A4. No Warranties; Limitation of Liability
The disclaimers, limitations of liability, release, and indemnity in the Terms of Service apply to Organizations. Be Small's total liability to an Organization for all claims will not exceed the greater of the fees the Organization paid in the 12 months before the claim arose or US $100. You will defend, indemnify, and hold harmless Be Small from all claims arising out of your groups, meetings, activities, leaders, members, Organization Data, or violation of law.
Part B: Data Processing Terms
B1. Roles
For Organization Data that is personal information, you are the controller (or business) and Be Small is your processor (or service provider). Be Small processes Organization Data only to provide, secure, and support the Services, on your documented instructions, which are these terms and your use of the Services' settings. We will tell you if we believe an instruction violates law.
B2. Details of Processing
Nature and purpose: hosting, storing, displaying, and transmitting data to run small groups, including sign-in, membership, messaging, reminders, and RSVPs.
Data subjects: your administrators, leaders, members, and people who request to join your groups.
Categories of data: names, email addresses, phone numbers, roles, group membership and requests, RSVPs, messages and resources, communication preferences and consent records, and technical log data. Group membership may reveal religious beliefs.
Duration: for as long as you use the Services, plus the deletion periods below.
B3. Be Small's Commitments
Be Small will:
keep Organization Data confidential and ensure anyone processing it is bound by a duty of confidentiality;
not sell Organization Data, use it for targeted advertising, or use it to train artificial intelligence models;
maintain reasonable security measures appropriate to the nature of the data;
use subprocessors only under written terms providing protections consistent with these terms; current subprocessors are Supabase, Vercel, Resend, Twilio (when texting is enabled), and Squarespace, and we will give notice of new subprocessors by updating our Privacy Policy, and you may object on reasonable grounds by emailing us within 15 days, in which case your remedy is to stop using the affected Services;
assist you, taking into account the nature of the processing, with responding to individuals' privacy requests and with any data protection assessments, at your reasonable expense where assistance is beyond the Services' standard features;
notify you without undue delay after becoming aware of a breach of security leading to unauthorized access to Organization Data;
at your choice, delete or return Organization Data at the end of the Services, unless law requires retention, with deletion from backups and logs on their normal schedules; and
make available information reasonably necessary to demonstrate compliance with these terms and allow reasonable assessments, no more than once a year, on 30 days' written notice, at your expense, and subject to confidentiality, which we may satisfy by providing written answers and documentation.
B4. Your Commitments
You represent that your instructions and your collection, use, and disclosure of Organization Data comply with law, and that you have provided all notices and obtained all consents required for Be Small to process Organization Data under these terms.
B5. Liability
Liability under these Data Processing Terms is subject to the limitations in Part A4.
